We are a first-party lender: business owners apply directly with us, we underwrite the application, and we originate and service the resulting loan. This authorization is made under the Fair Credit Reporting Act (FCRA).

6. Sharing Your Information

We do not sell consumer leads. We do not sell, rent, or transfer your information to any third party for that party’s own marketing purposes, and we do not participate in lead generation, lead resale, or affiliate marketing of any kind.

We may share your information only in the following limited circumstances:

• Service providers who help us operate our website, CRM, telephony, and communications systems, under contractual confidentiality obligations and solely to provide those services to us
• Funding partners, strictly for the purpose of processing, underwriting, and funding a financing application that you initiated with us. US America Capital originates and services the resulting loan and remains your point of contact throughout. Your information is not provided to these partners for their own marketing purposes.
• Regulators, law enforcement, or other parties where required or permitted by law

Exception for mobile and SMS data. No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

For clarity: your mobile phone number and your consent to receive text messages are excluded from all sharing described elsewhere in this section, including sharing with funding partners. Your consent to receive text messages from US America Capital does not transfer to any third party.

7. SMS and Text Messaging

Our text messages are transactional and customer care only. We do not send promotional or marketing text messages of any kind.

US America Capital collects mobile phone numbers and SMS consent through the opt-in checkbox on our website forms and, where applicable, through express consent given during a recorded phone call. We only send text messages to individuals who have given us their express consent directly.

By opting in, you consent to receive text messages from US America Capital relating to your funding application, limited to the following:

• Application status updates
• Requests for supporting documents, such as bank statements
• Appointment and call scheduling and confirmations
• Responses to your questions about an active application

We will not send you promotional messages, rate offers, product marketing, or any other unsolicited outreach by text message.

• Message and data rates may apply.
• Reply STOP to opt out at any time. Reply HELP for assistance.
• Opting out of text messages will not affect your funding application or your ability to contact us by phone or email.
• Consent to receive text messages is not a condition of purchase or of receiving any financing product.

Mobile opt-in data and consent are never shared with third parties, as described in Section 6.

8. Financial Privacy (GLBA)

As a financial services provider, we are subject to the Gramm-Leach-Bliley Act. We restrict access to your nonpublic personal information to employees and service providers who need it to provide products or services to you, and we maintain physical, electronic, and procedural safeguards to protect it.
